Terms of Service

These terms govern your use of MarkSentry: Trademark Scanner ("the app"), a Shopify app published by Aharon & Ita Corp ("we"). By installing the app you agree to them.

1. What the app does

The app uses artificial intelligence to look at your product images for signs of third-party trademarks, licensed characters and protected designs, and reports what it finds. It can set products to draft in your store when you tell it to.

2. Not legal advice

The app reduces risk; it is not legal advice. Its results are automated opinions that can be wrong in both directions: it can miss infringing content and it can flag content that is lawful. A "clean" result does not mean a product is cleared for sale, and an "infringes" result is not a legal finding. You remain solely responsible for what you sell and for complying with intellectual-property law. For decisions that matter, consult a qualified attorney.

The app is an aid, not a final solution. You use the app and its results at your own risk. We are not responsible if the app fails to detect a product or image that infringes third-party rights, or for any complaint, takedown, payment hold or account suspension related to a product the app did not flag, marked as "clean", or that you chose to keep for sale. Reviewing your catalog remains your responsibility.

3. Your store and your decisions

The app does not change your products unless you ask it to. Setting a product to draft, tagging it and recording the reason happen only when you press the corresponding button. You can reverse these changes in your Shopify admin.

4. Fees and billing

  • The free sample covers 50 products once per store.
  • The initial scan is a one-time charge based on the products left to scan after your free sample, as shown in the app before you confirm.
  • Monthly plans renew every 30 days. Products scanned over a plan's quota are charged at $0.03 each, up to the monthly cap you approve.
  • All charges are billed by Shopify through your Shopify invoice and are subject to Shopify's billing terms. Because each scan uses paid AI processing, completed scans are not refundable except where the law requires otherwise.
  • We may change prices with at least 30 days' notice in the app; changes apply from your next billing period.

5. Acceptable use

Do not use the app to scan content you have no right to access, to attempt to break or overload the service, or to resell its results as a legal clearance service.

6. Availability

We work to keep the app available and accurate but do not guarantee uninterrupted service or error-free results. We may change or discontinue features; if we discontinue the app, we will give reasonable notice.

7. Limitation of liability

To the fullest extent permitted by law, the app is provided "as is" without warranties of any kind, and we are not liable for indirect, incidental or consequential damages, lost profits, takedowns, account suspensions or claims by rights holders, including those about products the app did not flag. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

8. Termination

You can stop using the app at any time by uninstalling it. We may suspend access for a breach of these terms. Data is deleted as described in the Privacy Policy.

9. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.
